An impartial jury?


The Hungarian team has filed a protest with the meet director regarding the exclusion of Ferenc from the Worlds. The CIVL appointed jury is considering whether the protest is valid in itself. The local rules refer to complaints and protests but they do not really refer to situations such as this. They mainly relate to scoring issues.


The Hungarian association was "complaining" to CIVL and the meet organizers about the fact that their pilot was excluded from the list of registered pilots (first he was on it then taken off) quite a while before the meet. The meet director has in the days before the start of the meet made it quite clear that she would not allow him to fly (so was there a point to the complaint here?).


A few days before the meet one of the CIVL jury members, Scott Torkelson, was heard to state that this was a dead issue, that Ferenc would never be allowed to fly in the Worlds. According to the letter sent by Max Bishop on October 30 to the Hungarian association, John Aldridge, the jury president, has been previously been involved with Ferenc as a meet director and in other capacities.


I ask if these two jury members can be seen by both sides of the discussion as impartial, and whether they can in fact be impartial. To have justice all sides need to see that justice looks like it has an opportunity.


I would suggest that both John and Scott recuse themselves from the jury. I am aware that John and Scott have not done so and that they are already meeting and they may be making decisions.


My point of view here is that I want to see "due process." I know that both sides have tried to make the argument to me of the guilt or innocence of the individual, but I am not concerned about that. I am concerned that any individual in his situation get "due process" and I am not convinced by the evidence that I have see so far, that he or the Hungarian association has received that.


Of course, I am concerned for myself and others who may in the future find ourselves in the dog house with respect to the FAI and CIVL. I don't want any self censorship on my part if I feel that the FAI or CIVL has a hammer.
