SOP 9.01 (A) provides that a recall is initiated by presenting the
USHPA President with a request to initiate a recall. It doesn't require the
petitioner to provide the President with a request to initiate a recall prior to
gathering signatures in support of that recall effort. As President, I received
a formal request for initiation of a recall vote (the initiation of the petition
by the petitioner) on Feb. (sic) 24, 2010. Pursuant to the SOP, I forwarded
notice of that petition to Bob Kuczewski within one day of my receipt of that
petition, well within the 15 days required by the SOP. SOP 9.02 (B) provides that the petitioner has until 90 days after initiating the
petition (defined in 9-02 (A) as making a request to the President of the USHPA
for a recall vote) to submit the required signatures in support of the recall
petition. The SOP does not require that the petitioner wait until he has
initiated the petition before collecting signatures in support of his petition.
It merely requires that the required signatures must be submitted by the
petitioner to the Executive Committee within 90 days of his initiation of the
petition. In this case, the petitioner submitted the required signatures in
support of his petition simultaneously with the initiation of his petition. Even if initiation of the petition had not been defined in SOP 9.01 (A), the
earliest date that could otherwise be argued as an initiation date would be the
date the first signature was gathered. Since all the signatures were gathered
within the last 45 days, even if the SOP had not defined initiation of the
petition, all the signatures were submitted well within any 90 day period.
